ORDER

The allegation in this case is that on 04.10.2013, when the Tamil Nadu State Corporation bus was proceeding on its route, the accused, in an inebriated condition, drove his Maruti car bearing No. TN 33 AA 8267 and stopped before the bus and threatened the conductor and also abused him in filthy language and as such, a case was registered under Sections 341, 332, 294(b) and 506(ii) of Indian Penal Code, 1860 and Section 4(1)(j) of the Tamil Nadu Prohibition Act, 1937. The case is still pending for service on the accused.

2. Considering the nature of allegations, any future service and bringing the accused for trial would impinge upon his right to speedy trial under Article 21 of the Constitution of India.

3. Accordingly, the proceedings in C.C. No.100097 of 2017 on the file of the District Munsif cum Judicial Magistrate Court, Vazhapadi Taluk, Salem shall stand quashed and this Suo Motu Transfer Case stands allowed. 20.08.2025 nsl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
