Heard Mr.Gopalakrishnan for the petitioner and Mr.L.S.M.Hasan Fizal for the respondents 1, 2 and 4 and Mr.D.Veerasekaran for the third respondent.

2. This is an application to condone the delay of 869 days in filing an application to restore the writ petition which was dismissed for default on 13.04.2022.

3. The reason for the delay having occasioned is on account of the fact that the earlier counsel of the petitioner had, after filing the writ petition, been elevated as Judge of this Court. On account of that fact, when the matter was called, there was no appearance for the petitioner. After noticing the dismissal, the petitioner has engaged a new counsel and has filed this application. Though the learned counsels appearing for the respondents, opposed the application, being satisfied with the reasons given therein, I am inclined to condone the delay as I find sufficient cause to condone the delay.

4. Office is directed to number the restoration petition and list the matter for hearing on 03.12.2025.

5. When the application for restoration is listed for hearing, Registry shall print the name of Mr.D.Veerasekaran as counsel for the third respondent and Mr.L.S.M.Hasan Fizal as counsel for the respondents 1, 2 and 4.
