This application is filed to modify the condition (iv) in paragraph No.9 imposed on the petitioner in the order of this Court, dated 25.08.2022 in Crl.R.C.No.956 of 2022.

The learned Counsel for the petitioner, drawing the attention of this Court to paragraph No.2 of the application for modification, would submit that the said condition (iv) in paragraph No.9 causes grave prejudice to the petitioner inasmuch as only if he is permitted to go to Singapore, he can mobilise money and pay the sum of Rs.20,00,000/- and therefore, seeks modification of that condition alone.

3. I have considered the submissions made on behalf of the petitioner. The various conditions in paragraph No.9 of the said order are interdependent on each other. Only taking into account the overall facts and circumstances of the case to permit the petitioner to go to Singapore, such an order has been passed. As a matter of fact, this Court insisted for a larger amount and upon pleading by the petitioner, the amount of Rs.20,00,000/- was ordered to be deposited upfront and an opportunity was given to pay 1/3

another sum of Rs.20,00,000/- after his departure to Singapore within a period of thirty days. Therefore, modifying the said condition would amount to totally upsetting the entire order.

4. The learned Government Advocate (Crl. Side) and the learned Counsel appearing on behalf of the private respondent would also place before this Court the subsequent developments as to the cancellation of bail etc. Be that as it may, I find that the very prayer of3 modification by itself is without any merits and accordingly, this application is dismissed. 01.12.2022 grs 2/3
