Challenging the FIR in Crime No.5 of 2025 dated 05.01.2025 on the file of the Inspector of Police, T.R.Pattinam Police Station, Karaikkal District, Puducherry, the petitioners had filed the present Criminal Original Petition.
2. Heard the learned counsel for the petitioners and the learned Public Prosecutor (Pondy) appearing on behalf of the first respondent.
3. According to the petitioners, they are tenants and a complaint has been lodged against them as if they have forged the signature of the landlord and also stated that in this regard, a civil suit is pending.
4. I have perused the materials available on record.
5. The crux of the allegations is that the accused has forged the signature of the landlord in the rental deed and presented the agreement to the authorities in order to obtain trade license for running their business.
6. The learned Public Prosecutor (Pondy) submitted that the documents have been called for and sent to the Forensic department for comparison and they are awaiting the results.
7. Considering the facts of the case and also that without obtaining the expert's opinion as to whether the signature is forged or not by the petitioners, at this stage, this Court cannot quash the FIR as against the petitioners. This Court directs the Investigating Officer to conduct the enquiry in this matter in a fair manner and as per law.
8. For the aforesaid reason, the relief sought for by the petitioners cannot be granted and accordingly, the Writ Petition stands dismissed. 08.09.2025 DP Index:Yes/No NCC : Yes/No Order : Speaking/Non Speaking
