The learned Government Advocate (Crl.Side) appearing for the respondent police opposed the grant of bail to the petitioner and submitted that the alleged act was projected by the petitioner as an illicit affair with the defacto complainant. He further submitted that the investigation is still pending. 3.

It is alleged that the petitioner has committed a heinous crime against a disabled person and now contends before this Court that the act was consensual in nature.

Considering the nature and gravity of the offence, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed. The petitioner shall not be released on bail till the filing of the final report, since there is a possibility of his indulging with the victim girl and exploiting her physical disability.
