M/S.Unimed Technologies Ltd. And Another v. Cadila Healthcare Ltd And Another

A.No.7943 of 2019 in C.S.No.822 of 2013 N.SATHISH KUMAR.J., This application is filed by the applicants/plaintiffs to implead the proposed second respondent as the second defendant in the above suit.

2.M/s.C.Gladys Daniel, learned counsel takes notice for newly impleaded proposed second respondent, who also appearing for the first respondent has no objection in allowing the present application.

3.Having regard to the averments made in the affidavit filed along with the petition, this Court is of the view that the proposed party is also necessary for proper adjudication. Accordingly, this application is ordered.

4. The learned counsel for the plaintiffs is directed to carry out necessary amendment in the plaint and to file amended plaint copy by 22.11.2019.

5.Registry is directed to post the matter on 22.11.2019. Vakalat by then.
