Prayer: Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the 3rd respondent to release and return forthwith the original sale deed dated 16.07.2024, registered as document number 3794 of 2024 to the petitioner company, pending adjudication of proceedings, if any, for re-fixing the market value of the property which is the subject matter of the said sale deed.

The Writ Petition is filed for the following relief: "Directing the 3rd respondent to release and return forthwith the original sale deed dated 16.07.2024, registered as document number 3794 of 2024 to the petitioner company, pending adjudication of proceedings, 2/6

if any, for re-fixing the market value of the property which is the subject matter of the said sale deed".

2. Heard the learned counsels and perused the records.

3. In the counter filed by the 3rd respondent, the 3rd respondent has stated that the value arrived at is a sum of Rs.47.96 Crores and therefore the deficit stamp duty payable is Rs.19,57,200/-. The above figure has been arrived at on the basis of the order passed by the 2nd respondent dated 30.08.2024. This order has been brought to the notice of the petitioner today during the hearing of this Writ Petition. It was also stated that the original documents are with the Deputy Collector (Stamps).

4. On instructions, the learned counsel for the petitioner would submit that without prejudice to his right of appeal, the petitioner is ready to deposit the deficit stamp duty and the corresponding registration fees to the 3rd respondent.

5. Recording the above submission a direction is issued that on such payment, the 3rd respondent shall release the documents to the petitioner. The 3rd respondent shall ensure that he obtains the original documents from the Deputy Collector.

6. With the above lines, the Writ Petition is disposed of. No costs.
