ORDER

The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 123 of BNS and Sections 6(b) and 24(1) of Cigarette and other Tobacco Products Act, 2003, in Crime No.393 of 2025 on the file of respondent police, seek anticipatory bail.

2. The case of the prosecution is that the petitioners and other accused were in possession of 390 kgs. of banned tobacco products.

3. The learned counsel for the petitioners submitted that the petitioners have not committed any offence as alleged by the prosecution and they have been falsely implicated based on the confession of A2. He further submitted that the arrested accused A1 and A2 have been released on bail. Hence, he prayed to grant anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl. Side) appearing for respondent raised objections by stating that the quantity of tobacco products involved in this case is 390 kgs.

5. Considering the fact that a huge quantity of banned tobacco product is involved in this case and that the first petitioner is the native of Rajasthan, this Court is not inclined to grant anticipatory bail to the petitioners.
