The Petitioner has filed this writ petition seeking issuance of a Writ of Mandamus, to direct the Respondents to permit the Petitioner to retire from service as Noon Meal Organiser and pay him all his retirement benefits by considering his representation dated 23.09.2019.
2. Heard the learned counsel appearing for the Petitioner and the learned Government Advocate appearing for the Respondents.
3. The case of the Petitioner is that he was employed as Organiser of Noon Meal Scheme is Cuddalore District and he joined in service on 08.02.1983 and retired in the year https://hcservices.ecourts.gov.in/hcservices/
30.06.2003. The grievance of the Petitioner is that though he retired from service as early as in the year 2003, his retirement benefits have not been settled on the ground that there was audit objection and the Petitioner was issued notices to pay Rs.11,330/-. Thereafter, on 13.12.2017 the Petitioner had also paid the same amount without prejudice his contentions. Despite that also the retirement benefits of the Petitioner have not been settled. Hence, the Petitioner made a representation on 23.09.2019 to the Respondents praying to settle the retirement benefits. However as there is no action forthcoming, the Petitioner is before this Court.
4. The learned counsel appearing for the Petitioner would submit that without going into the merits of the case, it would suffice, if this Court issues direction to the Respondents to consider the Petitioner's representation dated 23.09.2019 and to pass appropriate orders.
5. Considering the limited request made by the learned counsel appearing for the Petitioner, I am inclined to issue direction to the Respondents to consider the Petitioner's representation dated 23.09.2019, on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.
