C.M.P.No.20555 of 2022 in C.M.A.SR.No.128273 of 2022 N.MALA,J, This Petition has been filed to condone the delay of 171 days in filing the above appeal against the order dated 31.08.2021 made in M.C.O.P.No.685 of 2017, on the file of the Motor Accidents Claims Tribunal Cum Sessions Judge, Mahila Court, Perambalur.

2. The learned counsel for the petitioners submits that the third respondent remained ex-parte in the Court below, further the third respondent was exonerated and therefore submits that the notice to the third respondent may be dispensed with and the learned counsel has made an endorsement to that effect.

3. Upon hearing the learned counsel for the petitioner and having satisfied with the reasons stated in the affidavit filed in support of this petition, the delay of 171 days is condoned.

Accordingly, this CMP is ordered.
