2.As seen from the affidavit filed in support of this application, the written statement has been filed on time. However, when the written statement was returned by the registry, the same was misplaced in the office of the counsel for the applicant/defendant. Only under those circumstances, there has been a delay of 138 days in re-presenting the written statement. 3.Even though the learned counsel for the respondent/plaintiff raised objections for allowing this application, this Court, after giving due consideration to the contents of the affidavit filed in support of this application, is inclined to allow this application as sufficient cause has been shown by the applicant/defendant for condoning the delay.
