The petitioner who was arrested and remanded to judicial custody on 14.08.2023 for the offences under Sections 147, 148, 302 of IPC r/w Section 3 of Explosive Substance Act, registered by the respondent Police in Crime No.524 of 2023, seeks bail.
2.The learned counsel for the petitioner stated that the petitioner is a college student who had completed a degree and his name had been implicated only based on the confession of the accused who had been taken into custody.
3.However, on the side of the respondent, it is stated that sofar as this petitioner is concerned, there had been meeting of mind even prior to the occurrence of the offence being completed and also subsequently, the petitioner had also given shelter to the accused who had committed the offence of murder.
4.This would imply that the petitioner had direct knowledge of the offence and he should not have granted shelter to the accused. It would also indicate that he had been directly involved in the actual act of murder.
5.Though this Court had granted bail to A12 earlier and today, by an order in Crl.O.P.No.24199 of 2023 to A13 and A14, the overt act as against them are different and they were the manager and driver of the Endee Infrastructure and Development Private Limited. 1/2 https://www.mhc.tn.gov.in/judis

vkr 6.However, this particular petitioner is one of those who had been engaged to commit the actual murder and though he has not participated in the offence of murder, prior to the murder, there had been a meeting of mind and subsequently, he has granted shelter to the accused.
7. In view of that particular fact though the petitioner is a student, at this stage, this Court is not inclined to grant bail to the petitioner.
