This petition has been filed seeking to direct the first respondent police to give Police Protection to survey the petitioner's property comprised in Survey No.299/3, and survey No.290/3B in Kutharayi Village, Ivanallur taluk, Myladuthurai District, pursuant to the petitioner's representation dated 19.10.2022.
2. The learned counsel for the petitioner submitted that the petitioner's husband owned a property comprised in Survey Nos.299/3 & 290/3B vide Patta No.96 measuring to an extent of 34 cents situated at Kutharayi Village. While being so, the 2nd respondent, who is being an adjacent land owner, often interferes with the peaceful possession and enjoyment of the said property. Therefore, the petitioner submitted an application to survey the said land before the concerned authorities and she has also paid required fee to the authorities concerned on 30.09.2022. Therefore, she seeks police protection to survey the land.
3. Heard the learned Government Advocate (crl. side) appearing for the first respondent.
4. It is seen that the petitioner has paid requisite fee to survey her land
before the concerned authorities. If the authorities concerned engage any surveyor to survey the petitioner's land, and the surveyor finds any hindrance to survey the land, he can very well seek police protection before the first respondent. On such request, the first respondent is directed to conduct enquiry and pass appropriate order to provide police protection while surveying the petitioner's land.
5. With the above directions, this Criminal Original Petition is disposed of.
