This Criminal Miscellaneous Petition has been filed seeking to direct the learned Special Court for cases under the Prevention of Corruption Act, Chennai to return the petitioner's passport bearing No.Z4460988 enable him to travel Australia for the present, which was surrendered as per the order passed by this Court in Crl.O.P.No.10351 of 2018 by the order dated 13.04.2018 in connection with the Crime No.01 of 2018 on the file of the Deputy Superintendent of Police, Vigilance and AntiCorruption, Chennai City V.
2. The learned Counsel for the petitioner would submit that, the petitioner's passport was surrendered before the Trial Court, pursuant to the order passed by this Court. On several occasions, the petitioners had filed petitions seeking direction for return of passport and this Court had also granted permission to him on the due compliance of the Order passed by this Court and that the petitioner after coming back to India, he had surrendered the passport. He would further submit that the petitioner is 1/3
boarding to Australia on 05.12.2022 and the petitioner undertakes that he will return to India and surrender his passport before the Trial Court within a period of four months from the date of boarding.

Considering the said submissions, this Court directs the learned Special Court for cases under the Prevention of Corruption Act, Chennai to return the petitioner's passport bearing Reg.No.Z4460988 for travelling to Australia and further, the petitioner is directed to surrender the same after a period of four months from the date of boarding, i.e., on 05.12.2022. It is made clear that the petitioner shall be duly represented by his Counsel before the Trial Court in his absence.
