ORDER
(Order of the Court was made by J.NISHA BANU, J.,) This writ petition has been filed to issue a Writ of Mandamus to direct the 1st respondent commission to take up the case in HRC No.2800 of 2020 on the file of the 1st respondent Commission for adjudication and decide the case according to the law in force.
2. This writ petition was disposed of by this Court on 15.11.2023. As there were few doubts to be clarified before signing the order, the matter was again posted under the caption 'for clarification'. When the matter was posted on 28.11.2023, the learned counsel for the petitioner sought time to file additional typed set and for further arguments and the matter is listed today (14.12.2023).
3. Heard the learned counsel for the petitioner and the learned counsel appearing for the 2nd and 3rd respondents.
4. Learned counsel for the petitioner would state that the complaint given by the petitioner in HRC.No.2800/2020 is pending before the 1st Page 2/5
respondent for a long time. Therefore, the petitioner made a representation to the 1st respondent on 20.04.2023 to dispose of the same expeditiously. But till date no action has been taken. Therefore, he would submit that a direction may be issued to dispose of the complaint given by the petitioner within a time frame to be fixed by this Court.
5. Considering the limited prayer sought for by the petitioner and also taking into account that the complaint is of the year 2020, the 1st respondent is directed to take up the case in H.R.C.No.2800/2020 pending on its file and dispose of the same on merits and in accordance with law within a period of three months from the date of receipt of a copy of this order. Accordingly, the Writ Petition is disposed of. No costs.
