ORDER
(1)Mr.M.Muthusamy, learned Government Advocate accepts notice on behalf of the 1 st respondent. Mr.U.M.Ravichandran, learned Special Government Pleader accepts notice on behalf of the 2 nd respondent. With the consent of the learned counsels on either side, the writ petition is taken up for final disposal at the admission stage.
(2)The writ petition is filed for a mandamus directing the 1 st respondent to furnish relevant documents relied on by the petitioner in his written representation dated 18.07.2025 so as to enable the petitioner to submit a detailed representation to the notice dated 14.07.2025 issued by the 1 st respondent under Section 87[1] of the Tamil Nadu Cooperative Societies, Act, 1983.
(3)The petitioner was working as the Secretary in the 2 nd respondent / Society.
While so, the petitioner was suspended from service for the alleged irregularities committed by him resulting in loss to the 2 nd respondent /Society. The petitioner states that though he was unconnected with the alleged irregularities, the Joint Registrar of Cooperative Societies / Chairman Common Cadre Authority issued the charge memo. The petitioner further states that the disciplinary proceedings are pending. Meanwhile, the petitioner approached the Enquiry Officer/1 st respondent to furnish certain documents. However, instead of furnishing the documents, the 1 st respondent issued notice on 14.07.2025, under Section 87[1] of the Tamil Nadu Cooperative Societies Act, 1983, calling upon the petitioner to submit his explanation.
The petitioner states that as he was under suspension, he was not able to collect the materials from the respondents to submit his detailed explanation. The petitioner therefore submitted a representation on 18.07.2025 to the 1 st respondent seeking copies of the documents relied upon in the 87 Surcharge notice. The 1 st respondent sent a communication to the petitioner on 06.08.2025, calling upon him to peruse the documents.
Thereafter, the petitioner visited to the office of the 1 st respondent and perused the documents. The petitioner states that the documents were voluminous running to nearly 1000 pages, and that in the absence of the copies being furnished, the petitioner would not be in a position to effectively contest the proceedings. Hence, having no efficacious remedy, the petitioner has filed the above writ petition for the aforesaid relief. (4)Learned Government Advocate appearing for the 1 st respondent, submitted that the 1 st respondent is ready and willing to furnish the copies of the documents referred to by the petitioner in Items No.1 to 11 mentioned in the petitioner's representation dated 18.07.2025, within a week from the date of receipt of a copy of this order.
The learned Government Advocate further submitted that the petitioner may also be directed to cooperate with the 87 enquiry, so as to enable its early conclusion. (5)Heard both sides and perused the materials placed on record.

The petitioner, on receipt of such documents, shall submit his explanation within a further period of two weeks thereafter and cooperate with the enquiry. In any event, the entire enquiry proceedings shall be completed within a period of twelve weeks from the date of receipt of a copy of this order. No costs.
