Prayer : Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the respondents 1 to 4 to regularise the petitioner's service in the Tamil Nadu Medical Services by either permitting the petitioner to continue his service at the Government Mohan Kumaramangalam College, Salem or in such other government medical college and hospital having vacancies commensurate with the petitioner's qualification and pass orders. This writ petition has been filed for the issue of writ of Mandamus directing the respondents 1 to 4 to consider the representation made by the petitioner on 18.06.2024 wherein the petitioner is seeking for regularisation of his service in the Tamil Nadu Medical Services by either permitting the petitioner to continue his service at Government Mohan Kumaramangalam College, Salem or in any other Government Medical College Hospital having vacancies commensurate with the petitioner's qualification.

Mr.M.Bindran, learned Additional Government Pleader for respondents 1 to 4 and Mr.L.Murugavel, learned Standing Counsel for 5th respondent. 3.
The case of the petitioner is that the 5th respondent issued a notification dated 11.10.2022 calling for application to fill up the post of Assistant Surgeon. The petitioner was issued a compulsory temporary bond posting order by posting him for a period of two years in the Government Mohan Kumaramangalam College, Salem by proceedings dated 20.11.2022. The petitioner accordingly joined as an Assistant Professor on 28.12.2022. Thereafter, the petitioner wrote the Medical Recruitment Board Examination in the year 2023 and secured 62.19 marks. The petitioner was under the impression that his services will be regularised by respondents 1 to 4 and he will be absorbed into the Tamil Nadu Medical Services. The petitioner also made a representation in this regard. Since the same did not evoke any response, the present writ petition has been filed before this Court. 4.
Taking into consideration the facts and circumstances of the case and also the nature of grievance that has been expressed by the petitioner and the materials that have been placed before this Court, there shall be a direction to the petitioner to make a fresh representation to the respondents 1 to 4 along all relevant 3/6
documents and also a copy of this order. The respondents shall deal with the same on its own merits and in accordance with law and final orders shall be passed within a period of eight weeks from the date of receipt of the representation from the petitioner.
