O R D E R
The petitioner, who was arrested and remanded to judicial custody on 18.05.2025, for the alleged offence under Section 397 of I.P.C. in Crime No.1323 of 2020, registered on the file of the respondent, seeks bail. 1/7
2.The learned counsel for the petitioner submits that an NBW was issued against this petitioner on 24.07.2025 for his non appearance, and he was arrested on 18.05.2025. He further submits that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prays for grant of bail to the petitioner.
3.The learned Government Advocate (Criminal side) appearing for the respondent Police submits that there are a total of four accused in this case, in which the petitioner has been arrayed as A4. He further submits that an NBW was issued against him on 24.07.2025 in S.C.No.164 of 2025 by the learned Sessions Judge, Villupuram and the same was executed on 18.05.2025. Hence, opposed for grant of bail to the petitioner.
4.Heard the learned counsels on either side and perused the records. 5.Considering the facts and circumstances of the case, the submissions made by the learned counsels on either side and the period of incarceration undergone by the petitioner, this Court is inclined to grant bail to the petitioner. 2/7
6.Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, each for a like sum to the satisfaction of the learned Additional Sessions Judge, Villupuram, and on further conditions that : [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity; [b] the petitioner shall report before the learned Additional Sessions Judge, Villupuram daily at 10.30 a.m. until further orders;
[c] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];
[d] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S. 3/7
