O R D E R

The petitioner, who was arrested and remanded to judicial custody on 31.07.2025 for the alleged offence under Sections 296(b), 115(2), 311, 351(3) of BNS Act, in Crime No.1001 of 2025, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner abused and assaulted the defacto complainant with knife and caused grievous injuries and also robbed Rs.270 from him. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submits that the petitioner has been suffering incarceration from 31.07.2025. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police opposed the grant of bail to the petitioner, stating that, the petitioner is having 4 previous cases against him. He also submitted that the investigation is almost completed.

5. Taking into consideration the facts and submissions made by both counsels, the investigation is almost completed, and also considering the period 2/5

of incarceration undergone by the petitioner, this court is inclined to grant bail to the petitioner with certain conditions.

Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties, in which one surety must be a blood surety for a like sum to the satisfaction of the learned XV Metropolitan Magistrate, George Town Court, Chennai, and on further conditions that:

(a) the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity; (b) the petitioner shall stay at Thanjavur and signed before the Town Police Station, Thanjavur, daily at 10.30 a.m. for a period of two months.

(c) the petitioner shall not tamper with evidence or witness either during investigation or trial;

(d) the petitioner shall not abscond either during investigation or trial;

(e) on breach of any of the aforesaid conditions, the Magistrate/ Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the Magistrate/Trial 3/5

Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560]; and; (f) if the accused thereafter absconds, a fresh FIR can be registered under Section 229-A IPC.
