W.M.P.No.31344 of 2019 in W.P.No.27807 of 2019 Dr.G.JAYACHANDRAN,J.

On hearing the writ petitions in W.P.Nos.27807 & 22947 of 2019, this Court taking into consideration the rival submissions of both sides in the respective writ petitions has passed the following order on 01.10.2019 :- "4. ..SIPCOT has decided to do fresh public auction inviting tender from the prospective parties and allot the land in accordance with the tender procedure and law governing."

2. The learned counsel appearing for the SIPCOT has filed the present petition to modify the order citing the procedure adopted by the SIPCOT for allotting the space for the public is not through open auction but by e-process.

3. It is brought to the notice of this Court that the SIPCOT allot the land with them through e-tender and the details along with specification of the land available will be uploaded in the website of SIPCOT inviting tender applications from the prospective buyers/lessee. Hence, the observation of this Court that SIPCOT has decided to do fresh public auction inviting tender from the prospective buyers has to be modified as SIPCOT shall allot the 1/3

space as per the procedure followed by them as per the Government norms.

4. If the SIPCOT is adopting alternate procedure instead of public auction inviting tender and the said process is transparent, this Court has no issue in modifying the above order.

5. The learned counsel for the SIPCOT submits that a fair and wide publication is made by the SIPCOT and public are allowed to participate in the process. Norms prescribed for applying are also published in the website of the SIPCOT.

6. In the said circumstances, Paragraph 4 of the order is modified as below:- "SIPCOT has decided to invite fresh offer as per the Government norms and the procedure henceforth adopted by the SIPCOT and allot the land in accordance with the tender procedure and law governing." 07.11.2019 rpl Dr.G.JAYACHANDRAN,J.
