The petitioner, who apprehends arrest at the hands of the respondent Police for the offences under Sections 353, 506(i) IPC and 20(1) of Cigaratte and Other Tobacco Products Act, 2003 in Crime No.357 of 2023 seeks anticipatory bail.

The learned counsel for the petitioner stated that the petitioner is an innocent person and he has been falsely implicated for the offences under Sections 353, 506(i) IPC and 20(1) of Cigaratte and Other Tobacco Products Act, 2003 in Crime No.357 of 2023. Thus, he seeks anticipatory bail to the petitioner.

3. It is stated by the learned Government Advocate (Crl.Side) that the respondent police had apprehended a lorry bearing No.UP 14 GT 5634. However, the lorry driver did not stop the vehicle and thereafter, got break down at Madhavaram. When a search was conducted, they found 30 white bags, containing tobacco products. The driver had been arrested. Thus, he prays for dismissal of this petition.

4. It is contended by the learned counsel for the petitioner that the petitioner is from Uttar Pradesh and he did not know about the transportation of banned product.

On the side of the respondent, it is stated that the petitioner is the owner of the lorry and according to them, during investigation, it was revealed that the petitioner is the owner of the contraband. Since investigation will have to be completed to find out the source of the contraband, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
