Hariharan v. State Rep By
Crl.O.P.No.23802 of 2023 Crl.O.P.No.23802 of 2023 C.V.KARTHIKEYAN , J.
The petitioner seeks bail in S.C.No.269 of 2023 now pending before the IV Additional Sessions Judge, Chennai. The petitioner is the 11th accused and charges had been framed under Sections 147, 148, 341, 326, 307, 506(ii), 120(B) r/w 149 of IPC.
2. It is stated that though the petitioner had been granted bail, he had taken a decision to abscond trial and a Non-bailable Warrant was issued on 17.07.2023 and the petitioner was secured on 04.08.2023.
3. It is however seen that as against A14 Non-bailable Warrant is still pending. It is clear that the accused are avoiding the Court process.
4. In view of that particular fact, I am not inclined to grant bail to the petitioner at this stage. Accordingly, this Criminal Original Petition stands dismissed.
