This Criminal Original petition has been filed to transfer the C.C.No.8640 of 2010 pending on the file of XI Metropolitan Magistrate Court, Saidapet to transfer the same to any other competent Court. 2.Heard the learned counsel for the petitioner and the learned Govt.Advocate (Crl.side) for the respondent.
3.It is seen from the records that the matter was posted for judgment on 31.10.2022. The counsel for the complainant filed a memo seeking adjournment for filing written argument. On the said request, memo was accepted and post the matter for submission of written argument on 11.11.2022. On 11.11.2022 written argument was submitted and the matter was reserved for judgment. At this juncture, the petitioner has filed the petition to transfer the entire case on the allegation that the accused persons are celebrating their acquittal. It is seen that admittedly, the matter was reserved for judgment and without even any material, the petitioner submitted that now the accused are celebrating their acquittal. The case is pending for judgment. Therefore, there is no material to substantiate the said allegation, this Court is not inclined to
allow the criminal original petition. Accordingly, the criminal original petition is dismissed.
