Madeshwaran v. The State Rep By Its,
T.V.THAMILSELVI, J.
The petitioner, who apprehends arrest for the alleged offence under Sections 420, 465, 467, 468 and 471 of IPC in Cr.No.8 of 2022, seeks anticipatory bail.
2. The case of the prosecution is that the defacto complainant's grandfather owned land in various survey numbers in Umanda Halli Village and Mallikuttai Village in Karimangalam Taluk, Dharmapuri district. Grandfather of the defacto complainant appointed the petitioner as his power of attorney agent through a power of attorney document dated 19.08.2010. It is alleged that one of the principal, Thirupathi Gounder passed away on 26.03.2016 and another principal, Ammasi passed away on 26.07.2018 when the defacto complainant verified the records he came to know that the petitioner colluded with the third accused and created fake life certificate dated 03.11.2020 and registered a sale deed in favour of the second accused on 05.11.2020. Hence the complaint.
3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the
prosecution and he has been falsely implicated in this case. Hence prays for grant of anticipatory bail.
4. The learned Government Advocate (Crl.Side) submitted that the petitioner was appointed as the power of attorney to the defacto complainant's grandfather who owned various lands in Dharmapuri district and thus the petitioner along with two others colluded and created fake life certificate and registered a sale deed in favour of the second accused. He further submitted that the investigation is pending in this case. Hence, he opposed to grant anticipatory bail to the petitioner.
5. Considering the facts and circumstances of the case and the gravity of offence committed by the petitioner, this court is not inclined to grant anticipatory bail to the petitioner.
6. Accordingly, this Criminal Original Petition is dismissed. 12.12.2022 dpq
