This petition is filed to condone the delay of 103 days in filing the above Civil Miscellaneous Appeal before this Court against the order dated 23.12.2022 made in M.C.O.P.No.390 of 2017, on the file of the Motor Accident Claims Tribunal / Special Subordinate Judge No.I, Salem.
2.Since first respondent remained ex parte before the Tribunal, notice to the first respondent is dispensed with.
3.Ms.I.Malar, learned counsel takes notice for the second respondent. 4.Heard. Having satisfied with the reasons stated in the accompanying affidavit filed in support of this petition, this petition stands allowed.
5.It is underscored that in the eventuality of the appellant succeeding in the appeal to be taken on record, he would not be entitled to any interest for 103 days.
6.The Registry is directed to print the name of the learned counsel for the second respondent in the cause list when the matter is listed for admission, and number the above C.M.A.SR.No.132192 of 2023, if the papers are otherwise in order.
