Respondents PRAYER:- Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ, order, or direction in the nature of a Writ of Mandamus directing the 2nd respondent conduct an enquiry and register the pending Document No.97 of 2018 dated 27.11.2018 in respect of our property in S.No.12/1, having the extent of 0.95 Cents of Erukkuvai village, Gummidipoondi Taluk, Thiruvallur District and further direct the respondents 1 & 2 to remove the illegal encumbrance created by respondents 3 & 4.

O R D E R

The present petition has been filed seeking a direction to the 2nd respondent to conduct an enquiry and to register the pending Document No.97 of 2018 dated 27.11.2018 in respect of the subject property along with certain other reliefs.

2. When the matter is taken up for hearing, learned Government Advocate appearing for the respondents submits that though the present petition has been filed for non-registration of the subject document, however, registration of the said document was refused vide the impugned order passed by the 2nd respondent. Without challenging the said order, filing of Writ Petition before this Court is not sustainable. However, a copy of the impugned order has also been served on the petitioner.

3. In view of the aforesaid submission, this Writ Petition is closed granting liberty to the petitioner to work out the remedy in the manner known to law. No Costs.
