The petitioner, who apprehends arrest at the hands of the respondent Police for the offences under Sections 328 IPC r/w Section 20(2) of Cigarette and Other Tobacco Products Act, 2003 in Crime No.301 of 2023 seeks anticipatory bail.

2. The learned counsel for the petitioner stated that the petitioner is an innocent person and he has been falsely implicated for the offences under Sections 328 IPC r/w 20(2) of Cigarette and Other Tobacco Products Act, 2003 in Crime No.301 of 2023. It is stated that the petitioner is running only a petty shop. He has nothing to do with the alleged seizure of tobacco products. Thus, he seeks anticipatory bail to the petitioner.

3. It is stated by the learned Government Advocate (Crl.Side) that the respondent police on 07.10.2023 recovered 39 kgs of banned tobacco products from the shop of the petitioner. Thus, he prays for dismissal of this petition.
