Criminal Original Petition is filed under Section 482 of Criminal Procedure Code, to withdraw the case in S.T.C.No.900 of 2012 on the file of Judicial Magistrate No.I, Mannargudi and transfer the same to the file of Judicial Magistrate-I, Pattukottai.

O R D E R

This petition has been filed seeking to transfer the proceedings in S.T.C.No.900 of 2012, pending on the file of the learned Judicial Magistrate-I, Mannargudi.

2.Taking into consideration the facts and circumstances of the case, this Court is not inclined to transfer the proceedings at this stage since the proceedings are pending for the last seven years.

3.The presence of the petitioner is dispensed with and she will be represented by a counsel before the Court below. The counsel representing the petitioner shall cross examine the witnesses on the same day they are examined in chief. The petitioner shall be present before the Court at the time of questioning 313 of Cr.P.C and at the time of passing of the final judgment.

4.This Criminal Original Petition is disposed of with a direction to the learned Judicial Magistrate-I, Mannargudi to complete the proceedings in S.T.C.No.900 of 2012 within a period of three months from the date of receipt of copy of this order.
