ORDER

This occurrence is of the year 2019. The case was registered in Crime No.126 of 2019 for the alleged offences under Sections 294(b), 323, 506(ii) of Indian Penal Code, 1860, Section 4(1)(j) of the Tamil Nadu Prohibition Act, 1937 and Section 75(1)(b) of the Tamil Nadu City Police Act, 1988.

2. The gist of the allegation is that when the defacto complainant was travelling in a bus, all the accused persons came in an inebriated condition, sat on the lap of the defacto complainant's son and when questioned, picked up a quarrel, abused, and caused minor hurt to the defacto complainant. The case is pending from 2019. The defacto complainant is not residing at the given address.

3. It is submitted on behalf of the police that they are not able to trace the defacto complainant. The warrant is pending against Accused No.4 and the same is not executed till date. The other accused are attending Court from the year 2019.

4. Considering the nature of the charge and the fact that the defacto complainant is not traced, the likelihood of conducting any meaningful trial is doubtful. Even if the trial is conducted hereinafter, the same would impinge upon the right to speedy trial of the accused.

5. Accordingly, the case in C.C.No.547 of 2020 on the file of the Judicial Magistrate II, Salem Taluk, Salem shall stands quashed and this Suo Motu Transfer Case stands disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
