ORDER

Initially this case was registered for the offence under Sections 279 and 337 of I.P.C. in Cr.No.99 of 2019. Later it was altered to Sections 279 and 304 (A) of I.P.C.

2.When the matter came up for hearing, it is represented that the injured has already got the compensation from the Motor Accident Tribunal. The accused does not have any other case except the same. The accused admitted his guilt.

3.Accordingly, considering the overall facts and circumstances of the case and the manner of the accident, I am of the view that the accused can be dealt with by granting lighter punishment. The accused pleading guilty convicted for the offences under Section 279 and 304 (A) of I.P.C and imposed a fine of Rs.200 for the offence under Section 279 I.P.C. and Rs.300 for the offence under Section 304 (A) of I.P.C. In all, the accused have to pay a total fine amount of Rs.500. The next date of hearing before the trial Court is on 18.09.2025 and the accused shall pay the fine on the said date before the trial Court. Accordingly, the Suo Motu Transfer Case stands disposed of. 4.The accused has also been attending the Court for the past five years, that is also taken into account.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
