ORDER

The allegation in this case is that on 24.10.2016, the accused drove the Ashok Leyland lorry bearing registration No. AP 04 TW 4209 and hit against a pedestrian and he succumbed to the injuries.

2. It can be seen that the case is pending for the past 9 years and the accused is from Andhra Pradesh and in spite of best efforts, service could not be completed. Even if the summons is served on the accused at a future date, considering the nature of allegations, the same would impinge upon the right 1/3

to speedy trial of the accused. No useful purpose will be served in keeping the matter pending.

3. Accordingly, the proceedings in C.C. No.660 of 2019 on the file of the Judicial Magistrate II, Salem Taluk, Salem stand quashed and this Suo Motu Transfer Case stands allowed.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
