ORDER

The allegation in this case is that, on 10.03.2014, when the deceased was travelling in a two wheeler, the lorry bearing Registration No. TN28W8686 was driven in a rash and negligent manner by the accused and hit against the two wheeler and the deceased suffered head injury and died. 2.

A case was registered in Cr.No.155 of 2014 for the offences punishable under Section 279 and 304(A) of Indian Penal Code. The Page No.1 of 3

chargesheet was also filed on 10.03.2014 and on 02.06.2014, the same was taken on file as CC No. 27 of 2015. It can be seen that, initially the accused was appearing in this case. However from the year 2022, it is stated that he has migrated to Andhra Pradesh as daily wage labourer and he has absolutely no roots whatsoever in the present place. His address remained untraceable till date. It is also seen that dependents of the deceased have also filed claim petition before the Motor Accidents Claim Tribunal and the compensation has been awarded.

In view thereof, no useful purpose will be served by keeping this petition pending, as the accident is of the year 2014. Accordingly, C.C.No.100125 of 2017 on the file of the District Munsif cum Judicial Magistrate, Vazhapadi Taluk is quashed and this Suo motu Transfer Case stands allowed.

The Trial Court shall take note of the order and accordingly pass consequential orders, by formulating / classifying the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider whether any consequential orders such as disposal of properties should be passed and if necessary shall pass such consequential order as may be necessary.
