ORDER

The nature of allegations in this case is that, accused was found to be in possession of 96 bottles of liquor bottles of 180 ml each. The accused was arrested and the motorcycle was also seized. Subsequently, the motorcycle was returned by way of interim custody. The whereabouts of the accused are not known and the case is pending from the year 2020.

2. It is stated on behalf the respondent Police that in spite of best of Page No.1 of 3

their ability, the accused is not residing the said address and the Village Administrative Officer has also given a certificate that the accused is not residing in the said village and his whereabouts is completely unknown.

3. In view of the fact that no efforts have been taken even to serve summons for the past five years and even if summons is served in future, the same will impinge upon the right to speedy trial of the accused and no useful purpose will be served by keeping the matter pending. Accordingly, the proceedings in S.T.C.No.658 of 2020 on the file of the Judicial Magistrate Court No.I, Ariyalur Taluk, Ariyalur stands quashed and the Suo Motu Transfer Case stands allowed.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
