ORDER
The allegations in this case is that, on 29.10.2019, when the diseased was walking along the left hand side of the road in Vadaveekam, Jayankondan, the accused drove the car bearing registration no.TN 72 BE 5001 in a rash and negligent manner and hit against the deceased, who died on account of the injuries.

Accordingly, a case was registered in Cr.No. 295 of 2019 for the offences under section 279 and 304 (A) of IPC on 29.10.2019 and thereafter, a charge sheet was also filed on 16.11.2019. It is submitted that before the Page No.1 of 3
summons could be served, the accused is a debtor who borrowed several amounts from several persons and unable to bear the pressure from the creditors and unable to repay his debts, he ran away from his place of abode in the year 2020 itself and from then on, he is unheard of till date. The efforts of the police to serve summons in this case, had proved futile and he remains untraceable. It is also submitted that the dependents of the deceased, have also filed claim petition before the Motor Accident Claims Tribunal and compensation has also been awarded.
3. In view thereof, considering the nature of accident and the allegations in this case, no useful purpose will be served in keeping the matter pending. Accordingly, the proceedings in C.C.No.17 of 2020 on the file of the learned Judicial Magistrate Court No.I, Jayamkondam Taluk, Ariyalur is quashed and this Suo Motu Transfer case is allowed.

The Trial Court shall take note of the order and accordingly pass consequential orders, by formulating / classifying the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider whether any consequential orders such as disposal of properties should be passed and if necessary shall pass such consequential order as may be necessary.
