ORDER
The allegation in this case is that on 03.04.2010, the accused interfered with the collection of rent by the defacto complainant and abused them in filthy language and also threatened to do away with their life. Accordingly, a case in Crime No.539 of 2010 was registered and thereafter, the charge sheet was filed and was taken on file as C.C.No.114 of 2010. Considering the nature of allegations, and the fact that PW.1 who was the prime witness also died and Page No.1 of 3
was not examined and therefore, no useful purpose will be served and continuing the trial after 15 years would impinge upon the right to speedy trial of the accused.
2. Accordingly, the proceedings in C.C.No.1800114 of 2010 on the file of the Judicial Magistrate III, Salem Taluk, Salem stands quashed and this Suo Motu Transfer Case stands allowed.
20.08.2025 rap electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
