JUDGMENT

This appeal is directed against the fair and decreetal order dated 23.06.2017 passed in DOP No.39 of 2014, by the learned District Judge, Nagapattinam.

2. When the matter was taken up on 16.03.2018, learned counsel for the appellant requested before this Court to withdraw his appearance as the appellant has not properly replied to him and therefore, this Court accepting his request ordered for fresh notice to the appellant. However, now, it is seen from the records that despite serving notice on the sole appellant on 23.03.2018 itself, he has not shown interest either to appear himself or to represent through counsel to defend his case. Therefore, on this count, the Civil Miscellaneous Appeal is dismissed for non-prosecution. No Costs. Consequently, connected miscellaneous petitions are closed.
