The petitioner had been secured under Prisoner in Transit warrant on 24.04.2023 and when he was in custody, in an another case, since Non-bailable Warrant had been issued against the petitioner on 13.09.2023. The petitioner is an accused in Crime No.128 of 2017 registered for the offences punishable under Sections 294(b), 506(ii) & 307 of IPC. He had been in judicial custody from 24.03.2023.

2. It is stated that after investigation, charge sheet had been filed and the same had been taken cognizance as PRC.No.13 of 2017 and subsequently, after committal, is now pending before the IV Additional Assistant Sessions Judge at Coimbatore in S.C.No.81 of 2023.

3. The learned counsel for the petitioner states that among the previous cases three of them are under IPC offences in which, the petitioner had been acquitted and seven others are under NDPS Act. https://www.mhc.tn.gov.in/judis

4. It is also contended that two other accused had been granted bail. However, the petitioner herein had absconded in September 2021. It is stated that now the case is posted for examination of L.W.1 to L.W.3.

5. Let the defacto complainant be examined on behalf of the prosecution and thereafter, the application for bail can be considered. At this stage, I am not inclined to grant bail to the petitioner.
