Respondent PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to recall the Non-bailable warrant dated 20.10.2022, pending against the petitioner in S.C.No.195 of 2015 on the file of the learned Principal District and Sessions Judge, Salem in Crime No.1199 of 2009 on the file of the respondent police station.

ORDER

This Criminal Original Petition has been filed to recall the non bailable warrant issued by the learned Principal District and Sessions Judge, Salem by order dated 20.10.2022 against the petitioner in S.C.No.195 of 2015.

2. The petitioner is arrayed as accused in S.C.No.195 of 2015, on the file of the Principal District and Sessions Judge, Salem for the offences punishable under Sections 147, 427, 353 of IPC and under Section 3(1) of Tamil Nadu Public Property (Prevention of Damage and Loss) Act.

3. The petitioner was absent during the trial in S.C.No.195 of 2015, on the file of the Principal District and Sessions Judge, Salem. Therefore non bailable warrant came to be issued on 20.10.2022.

4. The learned counsel appearing for the petitioner undertakes that the petitioner shall appear before the Court below regularly on all future hearing dates without fail.

5. Considering the undertaking given by the petitioner, the petitioner is directed to appear before the learned Principal District and Sessions Judge, Salem, within a period of two weeks from today and to file a petition to recall the NBW issued against him. The concerned Judge is directed to consider the same on merits and pass orders on the same day.
