ORDER

The allegation in this case is that on 05.04.2019, when the deceased was was riding his motorcycle bearing Registration No.TN 61 Q 2203, the accused was riding a TVS motorcycle bearing Registration No.TN 51 AX 1456 in a rash and negligent manner and cause the death of the victim.

2. When the matter came up for hearing today, it can be seen that the victim's family has already filed an application for compensation and the same Page No.1 of 3

has already been awarded. The address of the accused is in the state of Kerala and he remains untraceable as on date. Even though the final report is filed on 31.08.2019, the matter is pending and there appears to be no likelihood of the accused being brought to book.

3. It is seen that he has been permanently migrated to Kerala and his whereabouts are not known and no useful purpose will be served in continuing the case. The nature and the manner of the accident is also taken into account by this Court, where it seems to be a clash between two motorcycles. For all the above reasons, the case in C.C.No.14 of 2020 of Judicial Magistrate Court No.I, Jayamkondam Taluk, Ariyalur stands quashed and this Suo Motu Transfer case is allowed.

20.08.2025 rap electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
