ORDER

This case is registered for the offence under Sections 294 (b), 323, 324 and 506 (ii) of I.P.C.

2.Today, both sides present. It is stated that out of the four accused, accused No.1 Arun have since died, the case against him is treated as abated. The other accused are present.

3.The defacto-complainant would submit that the parties have moved on from the allegation and the case can be closed on compromise. Considering the fact that the Dedicated Bench is conducting this hearing in hybrid manner in an extraodinary situation without any affidavit whatsoever the compromise between the parties are recorded. After considering the facts and circumstances of the case, as per the dictum of the Hon'ble Supreme Court of Page No.1 of 3

India in Gian Singh Vs. Union of India, it is a fit case for exercise of power under Section 482 of Cr.P.C. Accordingly, the case in C.C.No.1700206 of 2018 on the file of the learned Judicial Magistrate II, Salem Taluk, Salem, shall stands quashed and the Suo Motu Transfer Case stands allowed. 22.08.2025 ep electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
