ORDER

The allegation in this case is that the defacto complainant and the accused are relatives. Both sides were dragging their grandmother for getting the land in their favour and in the process, this occurrence is said to have happened on 25.10.2021 and case is registered for an offence under section 294 (b), 323, 324 and 506(1) of the Indian Penal Code, 1860. When the matter came up for hearing, on behalf the police it is stated that, the ground situation between the parties have improved. Now, the case is pending from the year Page No.1 of 3

2021, only because the defacto complainant has gone abroad for his avocation.

2. In view of the nature of allegations and taking into account the fact that the parties are relatives and the parties have reached a better understanding and the fact that the prime witness is now working abroad and the case is pending, I am of the view that, no useful purpose will be served in keeping the case pending. Accordingly, the proceedings in C.C.No.92 of 2022 of Judicial Magistrate II, Attur Taluk, Salem stands quashed and this Suo Motu Transfer case is allowed.

20.08.2025 rap electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
