ORDER
The allegation in this case is that on 02.04.2020, the accused was operating the Crater vehicle bearing Regn.No.NL 02 Q 8363, whileso, he operated the same in a rash and negligent manner and caused injury to one of the workers in the spot. Thereafter, it was found that the spinal cord of the worker was affected and he was discharged from the hospital. After discharge, subsequently, he also died and as such, the case was originally registered under Sections 279 and 337 IPC, 1860 in Crime No.92 of 2020 on 02.04.2020 Page No.1 of 3
and was subsequently altered to Sections 279 and 304(A) of the Indian Penal Code, 1860. The final report is filed and the case is pending.
2. It is reported that the migrant workers are from Telangana State and they are the essential witnesse to prove the offence against the accused and they remained absolutely untraceable. The address originally given could be verified and the Police is not able to trace them. Similarly, the accused is also not remaining in the said address and the summons could not be served on the accused also. Under the said circumstances, the case is pending from the year 2020 and no useful purpose will be served by keeping the case pending and accordingly, the case in C.C.No.12 of 2022 of Judicial Magistrate Court No.II, Ariyalur Taluk, Ariyalur stands quashed and this Suo Motu Transfer case is allowed.
20.08.2025 rap electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
