ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025.

2. The allegation in this case is that on 23.10.2014 at about 17.00 hours, there was an altercation between the defacto complainant and the accused persons, while they are proceeding in their respective two wheelers. Hence a case in Cr.No.724 of 2014 for an offence under Sections 294 (b), 324 and 506 (ii) was registered. The case is pending from the year 2017 and now, it is posted at the stage of evidence. The defacto complainant does not want to pursue the case further. Considering the factual matrix, the context in which the conflict arose, the background of the parties, and their present position, this is an appropriate case for the exercise of jurisdiction under Section 482 of Code of Criminal Procedure as per Gian Singh Vs. State of Punjab & Another (2012 10 SCC 303).

Accordingly, the proceedings in CC.No.100149/2017 on the file of the Court of District Munsif cum Judicial Magistrate, Vazhapadi Taluk, Salem, stands quashed and this Suo Motu Transfer Case stands disposed of. 29.08.2025 Jer electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
