ORDER
This petition is filed by the petitioner to initiate contempt proceedings against the respondents for their willful disobedience of the order dated 10.11.2022 in W.P.No.8962 of 2019 passed by this Court.
2. Petitioner has preferred W.P.No.8962 of 2019 seeking direction to the fourth to sixth respondents to send forthwith their opinion pertaining to the second respondent's communication vide Na.Ka.16271/2018/EE1 Dated 04.09.2018 to the second respondent office and subsequently direct the second respondent to consider the petitioner's application dated 23.08.2018 seeking
sanction for the purchase of a portion of Private Forest land without the prior permission of the District Forest Committee situated at S.F.No.1/3A to an extent of 47.50 acres, Anaimalai Hills, Valparai Taluk, Coimbatore District within a stipulated time. On 10.11.2022, the Additional Government Pleader appeared on behalf of the respondents and filed a memo stating that petitioner's application would be placed for consideration in the meeting of the District Forest Committee, which was scheduled to be held in January 2023. Recording the submissions made by the Additional Government Pleader, W.P.No.8962 of 2019 was disposed of. Subsequently, petitioner sent a letter intimating Court's order to the respondent, however there was no response. Hence petitioner has sent a contempt notice on 14.03.2023, but there was no response from the respondents. Therefore, the petitioner is before this Court by way of this Contempt Petition.
3. Learned Government Advocate appearing for the respondents submitted a copy of the proceedings of the District Forest Committee and District Collector vide Paa.Mu.No.16271/2018/E1 dated 29.03.2025 before this
Court, wherein it is stated that the petitioner has not submitted the relevant documents with regard to possession and ownership of the subject property, hence the request of the petitioner could not be accepted by the respondents.
4. Heard both sides and perused the materials available on record.
5. In view of the submission made by the learned Government Advocate, this Contempt Petition stands closed. It is open to the petitioner to workout the remedy in the manner know to the law. No costs. 01-04-2025 jai Index:Yes/No Speaking/Non-speaking order Internet:Yes
