ORDER

A2, A3 and A5 are present before this Court in person. A1 and A4 are virtually present before this Court. The defacto complainant is also virtually present before this Court. The accused who are present physically and virtually assured that they will not disturb the survey stone / border stone and Page No.1 of 4

will not interfere with the affairs of the defacto complainant. The defacto complainant also submits that so long as the survey stone is not disturbed, she does not have any objection for closing the case. Both sides have thus compromised the issue and the settlement arrived at is recorded.

2. In view of the peculiar circumstances in which the dedicated bench is holding the hearings in a hybrid manner without any written affidavits on behalf of the parties, based on the oral statements made, the statement is recorded.

3. Considering the nature of the allegations, by virtue of the dictum of the Honourable Supreme Court of India in Gian Singh Vs. State of Punjab and Anr. reported in (2012) 10 SCC 303, this is a fit case for this Court to exercise the power under Section 482 of the Code of Criminal Procedure, 1973.

4. In view thereof, the case in S.T.C.No.1081 of 2020 shall stands quashed and the parties shall abide by the undertaking given before this Court. Page No.2 of 4

5. Accordingly, this Suo Motu Transfer Case stands disposed of. 22.08.2025 nsl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
