O R D E R
The petitioners herein apprehend arrest at the hands of the respondent police for the offences punishable under Section 126, 296(b), 115(2), 118(1), 303(2), 351(2) of the BNS in Crime No.214 of 2025, on the file of the respondent Police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioners, along with others, due to previous enmity, waylaid the de-facto complainant's car, attacked the occupants with iron rods, and also snatched a gold chain weighing 5 sovereigns. Hence, the case.
3. The learned counsel appearing for the petitioners states that the petitioners are innocent persons and they have been falsely implicated in this case. He further submitted that the complaint is a counter blast to the aggression of the de-facto complainant and his family members, who allegedly ransacked the provisions store of Rajesh and damaged the articles therein. A case in this regard has been registered in Crime No.214 of 2025 and is under investigation. Hence, he prayed for grant of anticipatory bail to the petitioners.
4. The learned Public Prosecutor (Crl. Side) submitted that, the injured 2/6
person in this case was discharged after treatment as an out-patient. The alleged stolen property is yet to be recovered. Hence, he opposed for grant of anticipatory bail to the petitioners.
5. Heard the learned counsels on either side and perused the materials available on record.
6.This Court, on considering the case and the counter case, finds that due to the enmity between two residents living opposite each other, the incident had occurred on 04.08.2025. The same transaction first resulted in the ransacking of the provision store belonging to one Rajesh, who is arrayed as A3 in Crime No.214 of 2025. Consequently, the present incident in Crime No.214 of 2025 had taken place. Hence, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions.

Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned V Metropolitan Magistrate, Chennai, on condition that the petitioners shall execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties 3/6
each within a period of 10 days from the date of receipt of a copy of this order for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that:
[a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity; [b] the petitioners shall report before the respondent police daily at 10.30a.m., until further orders; [c] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioners in accordance with law as if the aforementioned conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283]; [d] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
