Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the first respondent to sub divide S.F.No.65/8 Thimijepalli Village to an extent of 65 cents and issue sub division patta for the same extend as per the decree passed in O.S.No.163/2002 and I.A.No.165/2007 dated 18.11.2008 on the file of Sub Court Hosur, by considering petitioner application dated 12.06.2024 made to the respondents. O R D E R

The petitioner herein seeks a direction to the first respondent to consider his online application dated 12.06.2024 seeking sub-division and issuance of separate patta in respect of 65 cents of the land in S.F.No.65/8, Thimijepali Village, Krishnagiri District.

2. According to the petitioner, the above mentioned property was allotted to his share in the final decree passed by the Civil Court in IA.No.165 of 2007 in OS.No.163 of 2002 on the file of the Sub-Court, Hosur. Based on the Civil Court's decree, the petitioner submitted an online application seeking sub-division and issuance of separate patta and the same has not been considered. Hence, the petitioner is before this Court.

3. Mr.A.Selvendran, learned Special Government Pleader, who takes notice for the first respondent would submit that the online application of the petitioner will be considered, on its own merits, within a time frame fixed by this Court.

In view of the same, without going into the merits of the claim made by the petitioner, this Court is inclined to issue a direction to the first respondent to consider the online application of the petitioner dated 12.06.2024 and pass final order, on its own merits, within a period of 8 weeks from the date of receipt of copy of this order, after issuing necessary notice to petitioner and second respondent.

5. With the above direction, this Writ Petition is disposed of. No costs.
