The petitioner who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 4(1)(aaa), 4(1-A) & 14 A of TNP Act read with 420, 463, 465, 468, 471, 484, 486 & 488 of IPC in Crime No.644 of 2022 on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that the petitioner along with the coaccused was found in illegal possession of 7447 bottles of illicit liquor each containing 180 ml and 110 liters of illicit pondy arrack. Hence the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he is no way connected with the alleged offence. Hence he prays to grant anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner is an habitual offender against whom there is one previous case pending. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the quantity of the contraband involved and also the bad antecedent of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
