By consent, the above writ petition is taken up today for final disposal at the admission stage itself. In view of the order that this Court proposes to pass and also the limited relief that is sought to be granted, notice to the 2nd Respondent is hereby dispensed with.

It is the contention of the petitioner is that she has filed a petition under Section 23 of the Senior Citizen Act, 2007, before the 1st respondent on 28.02.2024 seeking to cancel the settlement deed executed by the petitioner on 22.02.2018 vide document No.1092 of 2018. It is her contention that the settlement deed was fraudulently obtained by her son. The 1st respondent on the petition filed by her had issued notice in Na.Ka.No.1158/2024/A4 dated 31.05.2024, calling upon the 2nd respondent to appear for enquiry. On 25.06.2024, the petitioner and the 2nd respondent, had appeared for enquiry and the 1st respondent had conducted the enquiry and recorded the statement of the petitioner and her daughter-in-law who had appeared on behalf of her son. Despite the enquiry having been completed on 25.06.2024, no order has been passed by the 1st respondent on the petition filed by the petitioner, thereby the present petition has been filed seeking for a direction to the 1st respondent to pass orders on merits.

3.Though a prayer had been sought seeking to cancel the settlement deed 2/4

dated 22.02.2018, without going into the merits of the case, a direction is issued to the 1st respondent to pass orders on the petition on which enquiry is conducted in Na.Ka.No.1158/2024/A4 dated 31.05.2024 within a period of four (4) weeks from the date of receipt of a copy of this order.

4. With the above direction, this Writ Petition stands disposed of. No costs.
