O R D E R

The Criminal Original Petition has been filed seeking a direction to the respondent Police not to harass the petitioner under the guise of investigation/enquiry.

It is the grievance of the petitioner that under the pretext of enquiry, even after obtaining anticipatory bail in all the three First Information Reports registered against him, the respondent Police are unnecessarily harassing the petitioner.

The learned Government Advocate (Criminal Side), on instructions, submitted that on the basis of the complaints given by the de facto complainants, cases have been registered and that after obtaining anticipatory bail orders, the petitioner has not appeared before the respondent for enquiry and is not co-operating with the investigation. 4.

In such circumstances, it is for the Investigating Agency to issue appropriate notice to the petitioner under Section 35(3) of BNSS for enquiry and on receipt of such notice, the petitioner shall appear for enquiry and cooperate with the investigation. If any cognizable offence is made out, the 2/4

respondent shall proceed in accordance with law.

5. Accordingly, this Criminal Original Petition stands disposed of with the aforesaid direction.
